This English version is provided for convenience. In the event of any discrepancy, the Spanish version shall prevail.

1.2 These Terms & Conditions (“Terms”) apply to all transport, delivery, logistics and related services provided by Axxis Costa del Sol (“Axxis”, “we”, “us”). By requesting or using our services, the customer (“you”) accepts these Terms.
2. Scope of Service
2.1 We provide local and provincial transport and logistics services, including urgent services, scheduled services and specialised transport (for example, motorbikes and bulky items) where availability allows.
2.2 Service availability depends on vehicle capacity, routes, access conditions and operational requirements.
3. Quotes, Prices and Inclusions
3.1 Quotes may be provided by email, telephone, WhatsApp or in writing. Unless stated otherwise, quotes are valid for seven (7) days.
3.2 The price is determined according to one or more factors, including distance, time, weight/volume, urgency, handling requirements and access conditions. A minimum or base charge may apply.
3.3 Unless the quote states otherwise, standard loading and unloading time, reasonable waiting time and basic handling with protection are included.
3.4 Additional charges may apply where circumstances increase the time, difficulty, risk or cost. This includes, for example, extended waiting, difficult access (such as no lift, narrow stairs, restricted parking or a long carry distance), additional labour or equipment, out-of-hours or weekend services, tolls, parking, permits, redeliveries, returns or failed deliveries caused by incorrect information or absence of the recipient.
4. Bookings and Customer Responsibilities
4.1 A booking is considered confirmed when Axxis accepts it in writing, including by email or message.
4.2 You must provide correct collection and delivery details, contacts, time window, description of the item, approximate size and weight, and any special handling requirement. You must also inform us about access, floor level, lift availability, restrictions and parking conditions.
4.3 Unless expressly agreed otherwise, you are responsible for ensuring that items are properly packed and suitable for transport.
4.4 You warrant that you have the legal right to send the items and that the items are lawful, safe and not prohibited under these Terms and applicable law.
5. Prohibited or Restricted Items
5.1 We do not transport illegal goods or unsafe or unlawful items, including weapons, explosives, flammable or hazardous materials, controlled substances, unsecured liquids or liquids liable to spill.
5.2 We do not transport animals or other living beings.
5.3 We do not transport cash, jewellery, precious metals, high-value or irreplaceable items unless declared in advance and accepted in writing, and subject to insurance limitations.
5.4 We may refuse any load that is unsafe, illegal, inadequately packed, incompatible with our vehicles or does not meet cover conditions.
6. Collection and Delivery
6.1 We will make reasonable efforts to meet agreed times; however, unless an expressly guaranteed time has been agreed, times are estimates.
6.2 We are not responsible for delays caused by circumstances outside our reasonable control, including traffic, accidents, roadworks, road closures, adverse weather, police checks, access restrictions or delays caused by third parties.
6.3 If delivery cannot be completed because the recipient is absent, details are incorrect or there are access problems, the service may be treated as a failed delivery and additional charges may apply.
7. Damage, Claims and Liability
7.1 We handle items with professional care. Any visible damage must be reported at the time of delivery, or as soon as reasonably possible if it was not detectable at that time.
7.2 Our liability is limited to direct and demonstrable physical damage caused by our handling or transport, and is subject to the condition of the goods at collection, adequate packing and compliance with handling instructions provided by you.
7.3 We are not liable for normal wear and tear, cosmetic marks on used items, damage resulting from insufficient packing, undeclared fragility or packing carried out by you that is unsuitable for transport.
7.4 We are not liable for indirect or consequential losses, including loss of profit, business interruption, missed appointments or similar losses.
7.5 Any claim must be sent in writing to info@axxiscostadelsol.es within forty-eight (48) hours following delivery, including a description and evidence such as photographs.
8. Insurance
8.1 Where included, transport may be covered by our goods-in-transit insurance, subject to limits, exclusions and the accuracy of the information provided by you.
8.2 High-value items must be declared in advance. Additional cover may be required, or we may refuse transport where the risk cannot be insured on acceptable terms.
9. Cancellations and Changes
9.1 Cancellations or changes must be requested as early as possible.
9.2 Late cancellations may incur a charge, particularly where resources have already been allocated, a time slot reserved or travel has begun.
10. Payment Terms
10.1 Unless otherwise agreed, payment will be due at the end of the service or as stated in the quote or invoice.
10.2 We may request a deposit for large jobs, high-demand time slots or long journeys.
10.3 Late payments may incur reasonable recovery costs and interest where permitted by law.
11. Force Majeure
11.1 We are not responsible for failure or delay caused by circumstances outside our reasonable control, including storms, strikes, accidents, road closures or government action.
12. Data Protection and Privacy
12.1 We process personal data in accordance with applicable law. Please see the Privacy Policy.
13. Applicable Law and Jurisdiction
13.1 These Terms are governed by Spanish law. Any dispute will be submitted to the courts and tribunals of Málaga, unless consumer law provides otherwise.
