1.2 These Terms & Conditions (“Terms”) apply to all transport, delivery, logistics, and related services provided by Axxis Costa del Sol (“Axxis”, “we”, “us”). By requesting or using our services, the customer (“you”) accepts these Terms.
2. Scope of Services
2.1 We provide local and regional transport and logistics services, including urgent deliveries, scheduled services, and specialist transport (such as motorcycles and bulky items) where available.
2.2 Service availability depends on vehicle capacity, routing, access conditions, and operational constraints.
3. Quotes, Pricing and Inclusions
3.1 Quotes may be provided by email, phone, WhatsApp, or in writing. Unless stated otherwise, quotes are valid for seven (7) days.
3.2 Pricing is determined by one or more factors including distance, time, weight/volume, urgency, handling requirements, and access conditions. A minimum charge or base rate may apply.
3.3 Unless your quote states otherwise, standard loading and unloading time, reasonable waiting time, and basic protective handling are included.
3.4 Additional charges may apply where circumstances increase time, difficulty, risk, or cost. This includes, by way of example, extended waiting time, difficult access (such as no lift, narrow stairs, restricted parking, or long carry distances), additional labour or equipment, out-of-hours or weekend services, tolls, parking fees, permits, re-delivery, return journeys, or failed delivery caused by incorrect information or recipient absence.
4. Bookings and Customer Responsibilities
4.1 A booking is confirmed once we accept it in writing, including by email or message.
4.2 You must provide accurate collection and delivery details, contact information, time windows, a correct description of the items, approximate size and weight, and any special handling requirements. You must also disclose relevant access details such as floor level, lift availability, restrictions, and parking conditions.
4.3 Unless expressly agreed otherwise, you are responsible for ensuring that items are properly packed and suitable for transport.
4.4 You confirm that you have the legal right to ship the items and that the items are lawful, safe, and not prohibited under these Terms or applicable law.
5. Prohibited and Restricted Items
5.1 We do not transport illegal goods or items that are unsafe or unlawful, including weapons, explosives, flammable or hazardous materials, controlled substances, unsecured liquids, or items likely to leak.
5.2 We do not transport animals or living creatures.
5.3 We do not transport cash, jewellery, precious metals, high-value collectibles, or irreplaceable items unless declared in advance and accepted by us in writing, and subject to any insurance limitations.
5.4 We may refuse any load that is unsafe, unlawful, inadequately packaged, incompatible with our vehicles, or outside our insurance conditions.
6. Collection and Delivery
6.1 We will make reasonable efforts to meet agreed timings; however, unless expressly agreed as guaranteed, all times are estimates.
6.2 We are not liable for delays caused by circumstances outside our reasonable control, including traffic, accidents, roadworks, road closures, severe weather, police controls, access restrictions, or third-party delays.
6.3 If delivery cannot be completed due to recipient absence, incorrect details, or access issues, the service may be treated as a failed delivery and additional charges may apply.
7. Damage, Claims and Liability
7.1 We handle items with professional care. You must report visible damage at delivery, or as soon as reasonably possible if the damage could not have been identified at that time.
7.2 Our liability is limited to direct, proven physical damage caused by our handling or transport, subject to the condition of the goods on collection, the adequacy of packaging, and compliance with any handling instructions provided by you.
7.3 We are not liable for normal wear and tear, cosmetic marks on pre-used items, damage caused by inadequate packaging, undeclared fragility, or items packed by you in a way that is unsuitable for transport.
7.4 We are not liable for indirect or consequential losses, including loss of profit, business interruption, missed appointments, or similar losses.
7.5 Any claim must be submitted in writing to info@axxiscostadelsol.es within forty-eight (48) hours of delivery, including a description and supporting evidence such as photographs.
8. Insurance
8.1 Where included, transport may be covered under our standard goods-in-transit arrangements, subject to policy limits, exclusions, and the accuracy of the information you provide.
8.2 High-value items must be declared in advance. Additional cover may be required, or we may refuse transport if the risk is not insurable on acceptable terms.
9. Cancellations and Changes
9.1 Cancellations or changes must be requested as early as possible.
9.2 Late cancellations may incur a fee, particularly where resources have been allocated, a time slot has been reserved, or travel has commenced.
10. Payment Terms
10.1 Unless agreed otherwise, payment is due upon completion of the service or as stated on the invoice or quote.
10.2 We may request a deposit for large jobs, high-demand time slots, or long-distance services.
10.3 Late payments may incur reasonable recovery costs and interest where legally permitted.
11. Force Majeure
11.1 We are not liable for failure or delay caused by events beyond our reasonable control, including severe weather, strikes, accidents, road closures, or governmental actions.
12. Data Protection and Privacy
12.1 We process personal data in accordance with applicable data protection laws. Please refer to our Privacy Policy
13. Governing Law and Jurisdiction
13.1 These Terms are governed by Spanish law. Any dispute shall be subject to the courts of Málaga, unless mandatory consumer law requires otherwise.
